These Terms of Service govern your use of the website greenpeaklandscapes.com and any services provided by Green Peak Landscapes ("Green Peak Landscapes", "we", "us"). By using this website or engaging our services, you agree to these terms.

2. Services
We provide garden design, landscape and hardscape construction, lawn and turf installation, planting and soft landscaping, irrigation and drainage systems, garden maintenance, and outdoor lighting and features across La Rioja, Spain.
All services are subject to a written proposal agreed with the client before any work begins.
3. Quotes and proposals
3.1 A quote request (via our website form, email, phone, or WhatsApp) does not constitute a contract.
3.2 A written proposal is provided following a site visit. The proposal specifies the scope of work, materials, timeline, and cost.
3.3 A contract is formed when you provide written acceptance of the proposal.
4. Payment
4.1 We accept payment by cash, bank transfer, or card.
4.2 A deposit is required before work commences. The deposit amount and percentage will be specified in the written proposal.
4.3 For larger projects, payments may be staged across agreed milestones as specified in the proposal. The balance is due on completion of the work.
4.4 Final payment is due on the date of completion, unless otherwise agreed in the written proposal.
4.5 Late payment may result in work being suspended until the outstanding balance is settled. We reserve the right to charge statutory interest on overdue amounts in accordance with Spanish law.
5. Changes to agreed scope
Any variation to the agreed scope of work must be agreed in writing before additional work proceeds. We will not carry out additional work or invoice for it without your prior agreement.
6. Cancellation
6.1 You may cancel an agreed project by giving us at least 14 days' written notice (by email to info@greenpeaklandscapes.com).
6.2 The deposit covers any work already committed or materials already ordered at the time of cancellation. Where cancellation occurs before any such commitment, a refund of the deposit will be discussed and agreed in writing.
6.3 We reserve the right to retain costs already incurred for materials ordered, sub-contractor commitments, or work completed up to the point of cancellation.
7. Limitation of liability
7.1 To the fullest extent permitted by applicable law, our liability for any claim arising out of or in connection with services provided is limited to the total amount paid for the services giving rise to the claim.
7.2 We are not liable for any indirect or consequential loss, loss of profit, or loss of opportunity arising from our services.
7.3 Nothing in these terms excludes or limits liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by Spanish law.
8. Warranties
8.1 We provide a 1-year workmanship warranty on installation work. This covers defects arising from the installation itself.
8.2 The warranty does not cover damage arising from neglect, misuse, weather events beyond normal La Rioja conditions, interference by third parties, or failure to follow any care instructions provided at handover.
8.3 To raise a warranty claim, contact us in writing at info@greenpeaklandscapes.com. We will assess and respond within five working days of receiving your claim.
9. Your rights as a consumer
If you are a consumer within the meaning of Spanish consumer law (Real Decreto Legislativo 1/2007), your statutory rights are not affected by these terms. Nothing in these terms seeks to limit rights granted to you by law.
10. Governing law
These terms are governed by the laws of Spain. Any disputes are subject to the jurisdiction of the courts of La Rioja, Spain.
